Investment Requirements

The EB-5 Visa program, established under the Immigration Act of 1990, requires applicants to make a significant investment that stimulates the US economy through job creation. There are two investment options:

  • Minimum investment of USD $1.8 million, or USD $800,000 in Targeted Employment Areas (TEAs).
  • Investment must create or preserve at least 10 full-time jobs.
  • Requires active management and supervision of the business.

Application Process

Prepare the EB-5 investor petition with legal assistance.

File the EB-5 investor petition with USCIS.

USCIS processes the petition (approximately 24 months).

Upon approval, the investor and family apply for conditional permanent residency visas.

Conditional permanent residency is granted for 24 months.

 File a petition to remove residency conditions.

Receive unconditional permanent residency.

US citizens and residents are taxed on worldwide income. Key tax considerations include:

  • Capital gains tax capped at 20%.
